PREMESSE
Il presente documento (definito anche “Contratto” o “Condizioni di servizio”) contiene i termini d’uso del Sito internet www.internationalpiccolofluteacademy.com (nel prosieguo anche “Sito” o Piattaforma”) e disciplina l’acquisto dei servizi “Academy Subscription” e “Academy Masterclass” (congiuntamente definiti anche per semplicità “I Servizi” e disgiuntamente “Il Servizio”). Prima di acquistare e di utilizzare il Servizi, invitiamo gli utenti a leggere con attenzione il presente documento in quanto costituisce un contratto vincolante tra l’utente stesso (in questo Contratto indicato anche con l’espressione “Cliente” o “Utente” o “Studente”) e Made in Orchestra S.r.l. (nel prosieguo definito per semplicità “IPFA”, “Fornitore” o “Titolare”). Le definizioni riportate in questo Contratto potranno essere utilizzate indifferentemente al singolare o al plurale. I termini che denotano un genere includono l’altro genere.

1. IDENTIFICAZIONE DEL FORNITORE E DATI DI CONTATTO
Il soggetto responsabile di questo Sito web e della prestazione del Servizio è:

2. OGGETTO E CARATTERISTICHE DEL SERVIZIO
Oggetto del presente Contratto è la regolamentazione del rapporto tra Utente e Fornitore in merito all’utilizzo del Sito e dei Servizi.
Il Servizio “Academy Subscription” consiste nell’accesso a materiali multimediali di qualsiasi formato (a titolo esemplificativo ma non esaustivo: video, audio, testo, pdf, immagine, libro, ecc.) per l’apprendimento e il perfezionamento del flauto ottavino ed eventuali altri argomenti ad esso correlati, trasmessi online in modalità “streaming” e/o altrimenti messi a disposizione dell’utenza in altre modalità (a titolo di esempio: file scaricabili), e definiti nel prosieguo “Contenuti”.
Il Servizio “Academy Subscription” prevede la facoltà per ciascun Utente abbonato di pubblicare sul Sito, in un’apposita pagina dedicata, una domanda scritta da rivolgere ai docenti indicati nella suddetta pagina. Il Titolare si riserva di selezionare alcune domande dell’utenza e di pubblicarne la risposta sul Sito attraverso un contenuto di qualsiasi formato (a titolo esemplificativo ma non esaustivo: testo, immagine, video, audio, libro, ecc.). L’Utente rinuncia sin da ora a qualsivoglia pretesa nei confronti di IPFA, anche a titolo di rimborso e risarcitorio, nel caso in cui le sue domande non venissero selezionate non potendo il Fornitore garantire, preventivamente alla selezione, che tutte le domande avranno risposta.
Il Servizio “Academy Masterclass” consiste nell’accesso a una o più lezioni live streaming con uno o più docenti, per l’apprendimento e il perfezionamento del flauto ottavino ed eventuali altri argomenti ad esso correlati.

3. DESCRIZIONE DELLE FASI TECNICHE NECESSARIE ALLA CONCLUSIONE DELL’ORDINE
3.1 Per usufruire del Servizio l’Utente è tenuto ad aprire un account indicando tutti i dati e le informazioni richieste in maniera completa e veritiera. Non è possibile usufruire del Servizio senza aprire un account Utente. È responsabilità degli Utenti conservare le proprie credenziali d’accesso in modo sicuro e preservarne la confidenzialità. A tal fine, gli Utenti devono scegliere una password che corrisponda al più alto livello di sicurezza disponibile su questo Sito web. Creando un account l’Utente accetta di essere pienamente responsabile di ogni attività posta in atto con le sue credenziali d’accesso. Gli Utenti sono tenuti a informare il Titolare immediatamente e univocamente tramite i recapiti indicati in questo documento qualora ritengano che le proprie informazioni personali, quali ad esempio l’account Utente, le credenziali d’accesso o dati personali, siano state violate, illecitamente diffuse o sottratte.
3.2 La registrazione di un account Utente su questo Sito è soggetta alle condizioni sotto specificate. Registrando un account, l’Utente conferma di soddisfare tali condizioni.
– L’apertura di account tramite bot o altri mezzi automatizzati non è ammessa.
– Salvo ove espressamente consentito o autorizzato per iscritto dal Titolare, l’account di un Utente non può essere condiviso con altre persone.
– L’Utente dichiara di essere maggiorenne.
L’account permette il salvataggio dei propri dati personali e l’accesso alle informazioni relative agli abbonamenti acquistati. Sarà possibile gestire e aggiornare i dati personali in qualsiasi momento.
L’Utente potrà reimpostare la propria password di accesso in qualsiasi momento, utilizzando l’apposito tasto attiguo a quello di registrazione.
3.3 Per finalizzare l’acquisto l’Utente, una volta scelto il servizio da acquistare, accede alla pagina che contiene il relativo modulo nel quale inserire tutti i dati richiesti per completare l’acquisto. In questa pagina sarà indicato anche il prezzo di acquisto. L’Utente s’impegna a controllare e convalidare, prima del relativo invio, i suoi dati personali, e il Servizio oggetto del Contratto. Per ogni eventuale errore, refuso o problema nella compilazione dei moduli online e, più in generale, nell’esecuzione delle procedure d’acquisto predisposte dal Fornitore, l’Utente potrà contattare quest’ultimo all’indirizzo support@internationalpiccolofluteacademy.com. Eseguiti i riscontri richiesti, spetterà, infine, all’Utente selezionare il tasto interattivo cliccando sul riquadro “ACTIVATE MY SUBSCRIPTION” nel caso di acquisto del Servizio Academy Subscription e “SIGN UP” nel caso di un acquisto del servizio Academy Masterclass, inoltrando così l’ordine al Fornitore. L’Utente è consapevole ed accetta che la selezione del tasto interattivo comporta la sottoscrizione al servizio selezionato e la piena e totale adesione dell’Utente al Contratto, l’obbligo di pagamento in favore del Fornitore ed il contestuale addebito dell’importo indicato.
3.4 L’accettazione online del presente Contratto da parte dell’Utente seguita dalla conferma via e-mail da parte del Fornitore (o un messaggio sul Sito o simile), equivale al perfezionamento del Contratto. Il messaggio di conferma conterrà anche le informazioni relative al servizio sottoscritto, all’importo pagato e alla durata.
3.5 In caso di violazione delle condizioni indicate alla clausola 3.2, il Fornitore potrà sospendere nonché revocare la Licenza sui Contenuti ed interrompere il Servizio, riservandosi di risolvere il Contratto per inadempimento con effetto immediato.

4. SERVIZIO ACADEMY SUBSCRIPTION
4.1 L’accesso ai Contenuti digitali compresi nel Servizio Academy Subscription potrà avvenire soltanto previo acquisto di un abbonamento. Pertanto, a fronte dell’osservanza dei termini e delle condizioni qui indicate, il Fornitore, in qualità di titolare dei diritti patrimoniali e della proprietà intellettuale sui Contenuti concede all’Utente un diritto d’uso personale, non esclusivo, revocabile, non trasferibile né cedibile, per una durata pari al periodo di abbonamento, di usufruire dei Contenuti digitali messi a disposizione dal Titolare (“Licenza”). Per usufruire dei Contenuti è richiesto l’accesso ad un’area riservata protetta da username e password. Fatta eccezione per la suddetta Licenza, nessun altro diritto, titolo o interesse sarà concesso all’Utente sui Contenuti.
4.2 Il Titolare avrà adempiuto l’obbligo di fornitura quando i Contenuti sono resi accessibili agli Utenti.
4.3 L’abbonamento ai Contenuti avrà la durata indicata durante la procedura d’acquisto e sarà soggetto a rinnovo automatico. È facoltà dell’Utente interrompere l’abbonamento in qualsiasi momento purché la notizia della disdetta giunga al Fornitore prima della data di rinnovo automatico. Per mantenere attivo l’abbonamento, l’Utente è tenuto a pagare tempestivamente il compenso periodico richiesto. In caso contrario, il Servizio potrebbe essere interrotto.
4.4 L’Utente può disdire l’abbonamento accedendo alle impostazioni del proprio account oppure inviando una e-mail direttamente al Fornitore all’indirizzo support@internationalpiccolofluteacademy.com. La disdetta comporta la cessazione dell’abbonamento e della Licenza sui Contenuti, che saranno accessibili fino alla data di scadenza dell’attuale periodo di abbonamento. La chiusura anticipata dell’account o la cessazione del Servizio non da, comunque, diritto alla restituzione nemmeno parziale degli importi versati a titolo di corrispettivo, fatto salvo quanto previsto per il recesso degli Utenti che rivestano la qualifica di consumatori residenti nell’Unione Europea.
4.5 Il Servizio è destinato ad un utilizzo personale e non commerciale, con finalità di apprendimento e studio. I Contenuti non possono essere scaricati, copiati, distribuiti, trasmessi, diffusi, mostrati durante spettacoli al pubblico, venduti, concessi in licenza a terzi, modificati, utilizzati per scopi commerciali o di altra sorta senza il previo consenso scritto del Fornitore.

5. SERVIZIO ACADEMY MASTERCLASS
5.1 Gli Utenti avranno accesso alle lezioni in live streaming con uno o più docenti solo quando l’acquisto si sia concluso con successo e il Fornitore abbia confermato via e-mail la partecipazione dell’Utente alla lezione.
5.2. La durata e le modalità di svolgimento della live streaming e delle interazioni con il docente vengono comunicate dal Fornitore a mezzo e-mail con almeno 1 giorno di anticipo rispetto alla data dell’evento.
5.3 Lo Studente è consapevole ed accetta che, qualora la lezione in streaming alla quale si è registrato richiedesse un numero minimo di partecipanti e tale numero non venisse raggiunto entro la chiusura delle iscrizioni, la lezione potrà essere annullata dal Fornitore. In caso di cancellazione per mancato raggiungimento del numero minimo di Utenti, quest’ultimo avrà diritto al rimborso dell’importo totale già corrisposto al Fornitore per lo specifico evento annullato. Non è previsto alcun risarcimento derivante dall’annullamento della lezione quando la sua cancellazione dipende dal mancato raggiungimento del numero minimo di Utenti eventualmente richiesto.
L’annullamento dell’evento viene sempre e comunque comunicato dal Fornitore a mezzo e-mail almeno 1 giorno prima della data dell’evento.
5.4 L’Utente è consapevole ed accetta che qualora l’evento dovesse essere parzialmente o integralmente annullato per qualsiasi motivo diverso da quello sopra citato (a titolo esemplificativo ma non esaustivo: indisponibilità improvvisa del docente) qualunque somma già fatturata e corrisposta sarà rimborsata pro rata temporis per la parte non fruita della lezione. Non è previsto alcun risarcimento derivante dall’annullamento della lezione oltre al rimborso totale o parziale dell’importo della lezione stessa.
5.5 Lo studente si impegna a partecipare effettuando il collegamento alla live streaming con puntualità e secondo gli orari e le modalità indicate a mezzo e-mail dal Fornitore, e accetta di non pretendere alcunché a titolo di rimborso qualora non dovesse presenziare all’evento per motivi che non dipendono dal Fornitore o dal docente.
5.6 Quando specificato dal Fornitore sul sito e sulle pagine di acquisto, la partecipazione alle live streaming può essere richiesta con ruolo di “Auditore”. La partecipazione come Auditore consiste nell’accesso alle live streaming ma non prevede l’interazione con il docente ad eccezione di specifici momenti e con specifiche modalità comunicati a mezzo email e/o durante l’evento dal Fornitore e/o dal docente.
5.7 Lo studente ha diritto ad accedere alle registrazioni delle live streaming effettuate dal Fornitore per un periodo di tempo limitato: le modalità e la durata dell’accesso vengono comunicate dal Fornitore nella pagina di acquisto della live streaming e/o a mezzo e-mail.
5.8 Lo studente non è autorizzato a effettuare registrazioni e/o download delle live streaming e delle registrazioni di queste rese disponibili dal Titolare.
5.9 Qualora la Masterclass a cui lo Studente è registrato lo preveda, al fine di permettere un’adeguata attività didattica da parte del Docente, lo studente ha facoltà di realizzare una o più registrazioni video, realizzandole secondo le istruzioni ricevute a mezzo email dal Titolare successivamente all’acquisto del servizio Masterclass, nelle quali esegue una o più performance musicali al fine che queste possano essere analizzate dal Docente per fini didattici durante la Masterclass.
Lo Studente invia ogni registrazione tramite upload (caricamento) nell’apposita area del proprio account, secondo le istruzioni ricevute a mezzo e-mail dal Titolare.
Lo Studente riconosce di essere l’unico responsabile della qualità audio e video delle proprie registrazioni, e che da questa dipende la qualità di comprensione da parte del Docente delle performance in esse registrate.
Lo Studente garantisce che le registrazioni inviate non ledono diritti di terzi, e non sono offensive nei confronti di terzi, manlevando e tenendo indenne il Titolare da ogni responsabilità derivante dalla pubblicazione delle registrazioni.
Lo studente cede in via esclusiva e definitiva al Titolare i diritti di utilizzazione economica delle registrazioni inviate, a titolo gratuito e senza nulla pretendere a qualsiasi titolo dal Titolare. Lo Studente autorizza il Titolare a cedere a terzi i diritti di utilizzazione economica delle registrazioni sotto qualsivoglia forma e per qualsiasi utilizzo.
Lo studente accetta che il Titolare possa a propria esclusiva discrezione scegliere di pubblicare sulla piattaforma e/o durante le live streaming le registrazioni inviate o di non pubblicarle, o di rimuovere dalla piattaforma registrazioni già pubblicate.
Lo studente autorizza il Titolare a effettuare video e audio editing e montaggi delle registrazioni inviate. Il Titolare si impegna a effettuare video e audio editing e montaggi senza ledere in alcun modo la dignità e il decoro dello studente.

6. PAGAMENTO DEL CORRISPETTIVO
6.1 I dettagli relativi ai mezzi di pagamento accettati sono evidenziati durante la procedura d’acquisto.
6.2 Il pagamento avviene online tramite i sistemi di pagamento riportati sul Sito. L’Utente dovrà inserire tutti i dati indicati come obbligatori nel modulo di pagamento. I servizi di pagamento sono gestiti da fornitori terzi, estranei a IPFA che in nessun caso entrerà in possesso né conserverà i dati di pagamento dell’Utente. Pertanto, IPFA declina qualsiasi responsabilità per un utilizzo fraudolento o comunque non autorizzato dei dati di pagamento immessi dall’Utente.
6.3 Sarà possibile richiedere tramite e-mail l’emissione di fattura elettronica che sarà emessa e conservata in conformità alla vigente normativa fiscale italiana. L’Utente è consapevole e accetta che sarà suo onere, in seguito alla registrazione, inviare via mail all’indirizzo info@internationalpiccolofluteacademy.com codice fiscale e/o partita IVA e/o altri dati per la fatturazione nel caso in cui lo stesso desiderasse l’emissione di una fattura con tale indicazione, entro 3 giorni dalla registrazione.
6.4 Fino alla ricezione del pagamento del prezzo integrale di acquisto da parte del Titolare, l’Utente non ottiene la Licenza sui Contenuti digitali né l’accesso alla Piattaforma e l’attivazione dell’abbonamento Academy Subscription e/o l’accesso ai Servizi Academy Masterclass.
6.5 L’abbonamento Academy Subscription decorre dal giorno in cui il Titolare riceve il pagamento e rimane attivo per tutto il periodo d’abbonamento.
6.6 Nel caso di acquisto di un abbonamento Academy Subscription, in fase di acquisto l’Utente accetta che sia già attivato il rinnovo automatico e autorizza il Fornitore ad elaborare automaticamente i pagamenti per acquisti futuri. L’autorizzazione può essere revocata in ogni momento utilizzando la propria area utente oppure inviando una e-mail direttamente al Fornitore all’indirizzo support@internationalpiccolofluteacademy.com. Nel caso in cui IPFA non sia in grado di addebitare l’importo dovuto ed autorizzato dall’Utente, IPFA potrà fatturare al Cliente il Servizio e sospendere l’accesso al Servizio fino ad avvenuto pagamento. In caso di revoca, l’abbonamento cesserà alla data di scadenza.
6.7 I prezzi di tutti i Servizi sono indicati in euro e comprensivi di IVA, ove dovuta.

7. DIRITTO DI RECESSO E RIMBORSO
7.1 Nel caso di acquisto di un abbonamento Academy Subscription, l’Utente ha il diritto di cancellare il proprio ordine di acquisto entro e non oltre 14 giorni dalla conclusione del Contratto, senza penalità e senza specificarne il motivo.
7.2 Nel caso dell’acquisto di un abbonamento Academy Subscription, oltre alla possibilità di esercitare il diritto di recesso previsto per legge, il Titolare concede all’Utente la facoltà di cancellare l’abbonamento ed ottenere il rimborso del prezzo entro i primi 30 giorni dalla data di attivazione. Questa politica, anche definita del “soddisfatto o rimborsato”, tuttavia varrà soltanto per la prima attivazione dell’abbonamento e potrà essere revocata dal Titolare in qualsiasi momento. Se il Titolare determina che l’Utente stia abusando della politica di rimborso, ci riserviamo il diritto di sospendere o chiudere il suo account e rifiutare o limitare qualsiasi utilizzo attuale o futuro del Servizio senza fornire un rimborso.
7.3 Per esercitare il diritto di recesso il Cliente dovrà inviare una comunicazione al seguente indirizzo e-mail: support@internationalpiccolofluteacademy.com. È facoltà del Cliente utilizzare il modulo di recesso reso disponibile al seguente link.
7.4 Senza indebito ritardo e comunque non oltre 14 giorni dal ricevimento della richiesta di recesso, il Fornitore procederà al rimborso dell’importo pagato utilizzando lo stesso strumento di pagamento utilizzato dal Cliente in fase di acquisto salvo che il Cliente abbia espressamente convenuto altrimenti e a condizione che questi non debba sostenere alcun costo quale conseguenza del rimborso.
7.5. Ai sensi dell’Art. 59 del Codice del Consumo, comma 1 lettera n) per i Servizi Academy Masterclass non troverà applicazione il diritto di recesso trattandosi di servizi riguardanti le attività del tempo libero con una data o un periodo di esecuzione specifici.

8. SOSPENSIONE E CANCELLAZIONE DELL’ACCOUNT
8.1 Il Titolare si riserva il diritto di sospendere immediatamente o nei casi più gravi di cancellare l’account dell’Utente risolvendo il Contratto al verificarsi di anche una soltanto delle seguenti circostanze:
– adottare una condotta non rispettosa nei confronti del Titolare e degli altri Utenti del Sito o dei docenti, anche attraverso la pubblicazione di commenti offensivi o contenuti non pertinenti o inappropriati;
– pubblicare informazioni e dati personali di terzi senza autorizzazione dell’interessato;
– inviare spam (pubblicità non richiesta, messaggi ripetuti);
– pubblicare sul Sito link che reindirizzano a siti esterni per finalità pubblicitarie o comunque per finalità estranee all’oggetto dei Servizi;
– pubblicizzare siti web o attività commerciali di terzi;
– caricare, pubblicare, inviare messaggi o in altro modo trasmettere o diffondere materiali, contenuti o testi che comportino la violazione dei diritti di proprietà industriale e/o intellettuale di terzi, o che tendano ad appropriarsi della popolarità di un marchio o di un’azienda utilizzandone il nome o marchio senza autorizzazione;
– scaricare, copiare, distribuire, pubblicare Contenuti e immagini presenti in questo Sito web, inclusi i dati degli Utenti o dei docenti che li hanno pubblicati senza la preventiva autorizzazione del Titolare;
– pubblicare, inviare o caricare messaggi, frasi, dati e contenuti che contengano imprecazioni, espressioni offensive o linguaggio che possa infastidire, molestare, imbarazzare, spaventare o disturbare gli altri Utenti, i docenti o il Titolare e contenuti che possano in qualsiasi altro modo ledere la dignità degli altri; contenuti che contengano spyware, adware, virus, file corrotti, worm o altri codici maligni idonei ad interrompere, danneggiare o limitare la funzionalità del Sito e più in generale del Servizio.
8.2 La sospensione o cancellazione dell’account e del Servizio per i motivi sopra indicati non dà all’Utente alcun diritto di risarcimento, rimborso o indennizzo. La sospensione o cancellazione di un account per cause addebitabili all’Utente non esonera l’Utente dal pagamento dei compensi o prezzi eventualmente applicabili.
8.3 Per i Servizi Academy Masterclass, lo Studente riconosce che il Titolare o il Docente hanno diritto a escludere qualsiasi Studente dalla diretta, anche solo parzialmente (a titolo esemplificativo ma non esaustivo: disattivando il microfono e/o oscurando la videocamera) a loro esclusivo ed insindacabile giudizio, qualora la condotta dello Studente venga considerata inappropriata e/o ostacoli il corretto svolgimento della lezione.
Lo Studente accetta che successivamente alla propria esclusione temporanea o permanente nulla avrà a pretendere dal Fornitore a titolo di rimborso e risarcimento.

9. PROPRIETÀ INTELLETTUALE
9.1 L’Utente riconosce e accetta che il Servizio possa contenere dati, informazioni o funzionalità protetti dal diritto d’autore e da diritti di proprietà intellettuale e industriale, quali marchi, software, codici, loghi, foto ed immagini, nomi e segreti commerciali. I Contenuti, i dati e le funzionalità della Piattaforma sono di esclusiva titolarità di IPFA e/o di terze parti che ne hanno concesso licenza d’uso a IPFA, e sono protetti contro l’uso non autorizzato, la copia e la diffusione dalla normativa in materia di proprietà intellettuale e industriale. Eventuali utilizzi dei Contenuti non in linea con quanto concesso dal Titolare comporta la violazione delle norme sul diritto d’autore e sulla proprietà intellettuale e saranno perseguiti sia in sede civile che penale.
9.2 Gli Utenti sono autorizzati ad usare i Contenuti ed il Sito unicamente nella misura in cui sia necessario od implicito nel corretto utilizzo del Servizio. In particolare, ma senza esclusioni, è fatto divieto agli Utenti di registrare, copiare, scaricare e condividere oltre i limiti specificati, modificare, tradurre, elaborare, pubblicare, trasmettere, vendere, concedere in sublicenza, trasformare, trasferire/alienare a terze parti o creare opere derivate a partire dal Contenuto disponibile su questo Sito web, di permettere a terze parti di intraprendere tali attività tramite il proprio account Utente o dispositivo, anche se a propria insaputa. Soltanto ove espressamente indicato su questo Sito web e nei limiti di quanto inderogabilmente consentito dalla normativa sul diritto d’autore, l’Utente è autorizzato a scaricare, copiare e/o condividere determinati contenuti disponibili su questo Sito esclusivamente per scopi personali e non commerciali ed a condizione che sia osservata l’attribuzione della paternità dell’opera nonché l’indicazione di ogni altra circostanza rilevante richiesta dal Titolare. Restano ferme le limitazioni ed esclusioni previste dalla normativa sul diritto d’autore. Il Sito stesso, il software, i marchi, i loghi, le immagini, le foto, i contenuti, la grafica, i modelli, i suoni, i testi appartengono al Titolare o ai suoi danti causa.
9.3 L’Utente che sottoscrive un abbonamento ottiene unicamente una licenza sui Contenuti nella misura strettamente necessaria a fruire degli stessi direttamente online tramite la Piattaforma, fatto salvo quando diversamente stabilito dal Titolare in maniera esplicita e per iscritto. L’uso dei Servizi non comporta alcuna cessione dei diritti sul Sito e sui Contenuti.

10. ESCLUSIONI DI RESPONSABILITÀ E GARANZIE
10.1 Tramite questo Sito web gli Utenti potrebbero avere accesso a risorse fornite da terzi. Gli Utenti riconoscono ed accettano che il Titolare non ha alcun controllo su tali risorse e che pertanto non risponde del loro contenuto e della loro disponibilità. 10.2 In particolare, su questo Sito web gli Utenti potrebbero imbattersi in avvisi pubblicitari forniti da terze parti. Il Titolare non controlla né modera le pubblicità visualizzate tramite questo Sito web. Cliccando su uno qualsiasi di tali annunci, l’Utente interagirà con la terza parte responsabile della pubblicità. Il Titolare non risponde di quanto può derivare da tale interazione con i terzi, dall’accesso a siti terzi o dall’uso di contenuti di terzi.
10.3 Per garantire il miglior livello di servizio possibile, il Titolare si riserva di interrompere il Servizio per finalità di manutenzione, aggiornamenti di sistema o per qualsiasi altra modifica, dandone, ove possibile, idonea notizia agli Utenti.
10.4 Nei limiti di legge, il Titolare si riserva di sospendere o terminare completamente il Servizio. In particolare, il Fornitore potrebbe sospendere il Servizio in via temporanea per interventi di manutenzione ordinaria o straordinaria sul Sito. Nelle ipotesi di sospensione del Servizio, Il Titolare si impegna a tenere informato l’Utente con anticipo rispetto a tale sospensione, anche dovuta ad eventuali aggiornamenti disponibili necessari al fine di mantenere la conformità del Servizio. Fatti salvi i casi di dolo e colpa grave, si esclude qualsiasi responsabilità per mancato funzionamento, temporaneo o permanente, parziale o totale del Servizio dovuto ad interventi di manutenzione, attacchi informatici e per altre cause che si sottraggono al ragionevole controllo del Titolare, incluso per forza maggiore (p. es. scioperi, malfunzionamenti infrastrutturali, blackout etc.).
10.5 Resta inteso che il Fornitore non può garantire il funzionamento ininterrotto del Servizio o l’assenza di malfunzionamenti di qualsiasi genere, né che sarà in grado di correggere tutti i difetti o i malfunzionamenti che potrebbero verificarsi durante il suo utilizzo. Tuttavia, pur non potendo garantire l’assenza di difetti o malfunzionamenti del software che potrebbero causare ritardi, interruzioni, sospensioni nell’uso del Sito, il Fornitore adopererà ogni ragionevole sforzo per intervenire senza ritardo al fine di ripristinarne la piena funzionalità. Restano pienamente applicabili le garanzie legali a tutela del consumatore che acquista i Servizi previste dal Codice del consumo (decreto legislativo 205/2006 e s.m.i.) artt. 128 – 135 septies. 10.6. Il Fornitore non fornisce l’attrezzatura per accedere ai Servizi. L’utente è responsabile di tutte le tariffe addebitate da terze parti in relazione all’accesso e all’utilizzo dei Servizi (a titolo esemplificativo ma non esaustivo: tariffe dei fornitori di servizi Internet, acquisto di webcam e/o microfoni, ecc.).Co

11. MODIFICHE AL CONTRATTO
11.1 Il Titolare si riserva il diritto di modificare in qualsiasi momento il presente Contratto, affinché sia sempre coerente con qualsiasi modifica dei Servizi o con eventuali sviluppi o vincoli legali, regolamentari, giurisprudenziali e/o tecnici.
11.2. In tal caso, il Titolare darà opportuna notizia delle modifiche agli Utenti. L’utilizzo continuato del Servizio implica l’accettazione dell’Utente delle Condizioni di servizio aggiornate. Nel caso in cui vengano apportate modifiche al Contratto che abbiano un impatto significativo sui diritti degli Utenti, sulle caratteristiche del Servizio o sulle tariffe applicabili, l’Utente avrà il diritto di recedere dal Servizio o dai Servizi sottoscritti inviando al Titolare una comunicazione a mezzo e-mail o accedendo alle impostazioni del proprio profilo, senza alcuna penale, entro e non oltre il termine di 15 giorni dal ricevimento della comunicazione via e-mail. La versione precedente applicabile continua a disciplinare il rapporto fino all’entrata in vigore delle nuove Condizioni. Tale versione può essere richiesta al Titolare.
11.3. Ogni modifica di queste Condizioni di servizio sarà comunicata per iscritto via e-mail almeno 30 giorni prima di diventare efficace. Qualora il Cliente non dovesse accettare eventuali modifiche sostanziali alle Condizioni di servizio proposte dal Titolare, avrà il diritto di recedere dal Contratto. Qualunque somma fatturata per il periodo sarà rimborsata pro rata temporis per la parte non fruita dell’abbonamento, a esclusione del mese in cui l’Utente ha esercitato il diritto di recesso. Il Titolare specificherà la data entro cui le modifiche alle Condizioni di servizio entreranno in vigore.

12. MISCELLANEA
12.1 Il Titolare potrebbe offrire sconti o promozioni speciali per l’acquisto del Servizio. Tali promozioni o sconti sono sempre soggetti ai requisiti ed a termini e condizioni previste nella relativa sezione di questo Sito web. Promozioni e offerte sono sempre concesse a sola discrezione del Titolare. Promozioni o sconti ripetuti o periodici non costituiscono alcuna pretesa o diritto azionabili dagli Utenti in futuro. A seconda dei casi, sconti e promozioni valgono per un determinato periodo di tempo o fino ad esaurimento scorte. Salvo ove diversamente specificato, le limitazioni di tempo di promozioni e sconti si intendono riferite al fuso orario della sede del Titolare, come indicata nei recapiti in questo documento. Promozioni e sconti possono essere offerti sotto forma di buoni o codici promozionali. In caso di violazione delle condizioni applicabili ai buoni o codici promozionali, il Titolare può legittimamente rifiutare di adempiere ai propri obblighi contrattuali e si riserva espressamente il diritto di agire nelle opportune sedi anche giudiziarie al fine di tutelare i propri diritti e interessi. Eventuali disposizioni aggiuntive o divergenti applicabili all’utilizzo dei buoni o codici promozionali riportate nella relativa pagina informativa o sul buono stesso prevalgono in ogni caso, a prescindere dalle disposizioni che seguono. Salvo ove diversamente specificato, le seguenti regole si applicano all’utilizzo dei buoni o codici promozionali:
– ciascun buono o codice promozionale è valido solo se utilizzato secondo le modalità e nel periodo di tempo specificati sul sito web e/o sul buono;
– il buono o codice promozionale può essere riscattato solo integralmente al momento dell’acquisto (non è consentito l’utilizzo parziale);
– salvo ove diversamente specificato, i buoni o codici promozionali monouso possono essere riscattati una sola volta per acquisto e possono pertanto essere riscattati una sola volta anche nel caso di acquisti rateizzati;

– il buono o codice promozionale è da intendersi esclusivamente ad uso non commerciale. La riproduzione, contraffazione e commercializzazione del buono o codice promozionale sono severamente vietate, così come qualsiasi attività illecita connessa all’acquisto e/o utilizzo del buono o codice promozionale.
12.2 Gli Utenti non sono autorizzati a riprodurre, duplicare, copiare, vendere, rivendere o sfruttare questo Sito web o il Servizio in toto o in parte senza previo consenso scritto del Titolare, espresso direttamente o attraverso un legittimo programma di rivendite.
12.3 Le informazioni sul trattamento dei dati personali sono contenute nella privacy policy di questo Sito web.
12.4 Fermo restando per qualsiasi previsione più specifica prevista in questo Contratto, i diritti di proprietà intellettuale ed industriale, quali ad esempio diritti d’autore, marchi, brevetti e modelli relativi a questo Sito web sono detenuti in via esclusiva dal Titolare o dai suoi danti causa e sono tutelati ai sensi della normativa e dei trattati internazionali applicabili alla proprietà intellettuale. Tutti i marchi – denominativi o figurativi – ed ogni altro segno distintivo, ditta, marchio di servizio, illustrazione, immagine o logo che appaiono in collegamento con questo Sito web sono e restano di esclusiva proprietà del Titolare, dei suoi danti causa o di terze parti e sono tutelati ai sensi della normativa e dei trattati internazionali applicabili alla proprietà intellettuale.
12.5 L’Utente presta sin da ora il proprio consenso affinché il Titolare possa trasferire o cedere a terzi, i diritti e le obbligazioni di cui al presente Contratto. L’Utente non è autorizzato a cedere o trasferire i propri diritti e le proprie obbligazioni secondo le Condizioni di servizio senza il consenso scritto del Titolare.
12.6 Tutte le comunicazioni inerenti all’uso di questo Sito web devono essere inviate ai recapiti indicati in questo documento.

13. LEGGE APPLICABILE E FORO COMPETENTE
13.1 Gli Utenti possono segnalare eventuali controversie al Titolare, che cercherà di risolvere in via amichevole. Per quanto resti impregiudicato il diritto degli Utenti di promuovere un’azione in giudizio, in caso di controversie inerenti all’uso di questo Sito web o al Servizio, gli Utenti sono pregati di contattare il Titolare ai recapiti indicati in questo documento. 13.2 Il presente Contratto è disciplinato dalla legge italiana senza applicazione delle norme sui conflitti di legge. Per gli Utenti residenti nell’Unione Europea che rivestano la qualifica di consumatori, il foro competente a decidere di eventuali controversie sarà quello di loro residenza.

INTRODUCTION
This document (also referred to as the “Agreement” or “Terms of Service”) contains the terms of use of the website www.internationalpiccolofluteacademy.com (hereinafter also referred to as the “Site” or Platform”) and regulates the purchase of the “Academy Subscription” and “Academy Masterclass” ( for simplicity, also referred to as “The Services” jointly and “The Service” each). Before purchasing and using the Services, users are invited to carefully read this document, as it constitutes a binding contract between the user (also referred to in this Agreement with the expressions “Customer” or “Student ”) and Made in Orchestra S.r.l. (hereinafter referred to for simplicity as “IPFA”, “Supplier” or “Data Controller”). The definitions contained in this Agreement may be used indifferently in the singular or in the plural.

2 OBJECT AND CHARACTERISTICS OF THE SERVICE
The subject of this Contract is the regulation of the relationship between the User and the Supplier regarding the use of the Site and the Services. The “Academy Subscription” service consists of gaining access to multimedia materials of any format (by way of example but not limited to: video, audio, text, pdf, image, book, etc.) for learning and perfecting the piccolo and any other topics related to it, transmitted online in “streaming” mode and/or otherwise made available to users in other ways (by way of example: downloadable files), and defined below as “Contents”.
The “Academy Subscription” Service provides each subscriber User with the right to publish on the Site a written question to be addressed to the teachers on a specific page, indicated on the page itself. The Owner reserves the right to select some user questions and to publish the answer on the Site through content of any format (by way of example but not limited to: text, image, video, audio, book, etc.). The User hereby waives any claim against IPFA, also by way of reimbursement and compensation, in the event that their questions are not selected as the Supplier cannot guarantee, prior to the selection, that all questions will be answered.
The “Academy Masterclass” service consists of gaining access to one or more live streaming lessons with one or more teachers, for learning and perfecting the piccolo flute and any other related topics.

3 DESCRIPTION OF THE TECHNICAL PHASES NECESSARY FOR THE CONCLUSION OF THE ORDER
3.1 To use the Service, the User is required to open an account indicating all the data and information requested in a complete and truthful manner. It is not possible to use the Service without opening a User account. It is the responsibility of the Users to keep their access credentials secure and to preserve their confidentiality. To this end, Users must choose a password that corresponds to the highest level of security available on this Website. By creating an account, the User agrees to be fully responsible for any activity carried out with their ogin credentials. Users are required to inform the Owner immediately and unambiguously through the contact details indicated in this document if they believe that their personal information, such as the User account, login credentials or personal data, have been violated, unlawfully disseminated or subtracted.
3.2 The registration of a User account on this Site is subject to the conditions specified below. By registering an account, the User confirms that it meets these conditions:
– The opening of accounts through bots or other automated means is not allowed.
– Except where expressly permitted or authorized in writing by the Owner, a User’s account cannot be shared with other people.
– The User declares to be of age.
The account allows you to save your personal data and access information relating to the subscriptions purchased. It will be possible to manage and update your personal data at any time.
The User can reset their access password at any time, using the appropriate button adjacent to the registration one.
3.3 To finalize the purchase, once the User has chosen the service to purchase, they shall access the page that contains the relevant form in which to enter all the data required to complete the purchase. The purchase price will also be indicated on this page. The User undertakes to check and validate, before sending it, their personal data, and the Service object of the Contract. For any error, misprint or problem in completing the online forms and, more generally, in carrying out the purchase procedures prepared by the Supplier, the User can contact the latter at the address support@internationalpiccolofluteacademy.com. Once the required checks have been performed, it will finally be up to the User to select the interactive button by clicking on the “ACTIVATE MY SUBSCRIPTION” box in the case of a purchase of the Academy Subscription Service and “SIGN UP” in the case of a purchase of the Academy Masterclass service, thus forwarding the order to the Supplier. The User is aware and accepts that selecting the interactive key entails subscribing to the selected service, as well as the User’s full and total adherence to the Contract, the obligation to pay the Supplier and the simultaneous charge of the indicated amount.
3.4 The online acceptance of this Contract by the User followed by the confirmation via e-mail from the Supplier (or a message on the Site or similar) is equivalent to the completion of the Contract. The confirmation message will also contain information relating to the subscribed service, the amount paid and the duration.
3.5 In case of violation of the conditions indicated in clause 3.2, the Supplier may suspend and revoke the License on the Contents and interrupt the Service, reserving the right to terminate the Contract for breach with immediate effect.

4. ACADEMY SUBSCRIPTION SERVICE
4.1 Access to the Digital Content included in the Academy Subscription Service can only take place after purchasing a subscription. Therefore, in compliance with the terms and conditions indicated here, the Supplier, as owner of the patrimonial rights and intellectual property on the Contents, grants the User a personal, non-exclusive, revocable, non-transferable right of use or transferable, for a duration equal to the subscription period, to use the digital Contents made available by the Owner (“License“). To use the Contents, access to a reserved area protected by username and password is required. Except for the aforementioned License, no other right, title or interest will be granted to the User in the Content.
4.2 The Owner will have fulfilled the supply obligation when the Contents are made accessible to Users.
4.3 The subscription to the Contents will have the duration indicated during the purchase procedure and will be subject to automatic renewal. The User has the right to terminate the subscription at any time as long as the notice of cancellation reaches the Provider before the automatic renewal date. To keep the subscription active, the User is required to promptly pay the periodic fee requested. Otherwise, the Service may be interrupted.
4.4 The User can unsubscribe by accessing their account settings or by sending an e-mail directly to the Provider at support@internationalpiccolofluteacademy.com. Cancellation involves the termination of the subscription and the License on the Contents, which will be accessible until the expiration date of the current subscription period. The early closure of the account or the termination of the Service does not give, however, the right to even partial refund of the amounts paid by way of consideration, except for the provisions for the withdrawal of Users who qualify as consumers resident in the European Union.
4.5 The Service is intended for personal and non-commercial use, for learning and study purposes. The Contents must not be downloaded, copied, distributed, transmitted, disseminated, shown during public performances, sold, licensed to third parties, modified, used for commercial or other purposes without the prior written consent of the Provider.

5. ACADEMY MASTERCLASS SERVICE
5.1 Users will have access to live streaming lessons with one or more teachers only when the purchase has been successfully concluded and the Supplier has confirmed the User’s participation in the lesson via e-mail.
5.2. The duration and modalities of the live streaming and interactions with the teacher are communicated by the Supplier by e-mail at least 1 day in advance of the date of the event.
5.3 The Student is aware and accepts that, if the streaming lesson for which they have registered requires a minimum number of participants and this number is not reached by the closing date for registration, the lesson may be cancelled by the Supplier. In the event of cancellation due to failure to reach the minimum number of Users, the latter will be entitled to a refund of the total amount already paid to the Supplier for the specific cancelled event. There is no compensation deriving from the cancellation of the lesson when its cancellation depends on the failure to reach the minimum number of users possibly required.
The cancellation of the event is always and in any case communicated by the Supplier by e-mail at least 1 day before the date of the event.
5.4 The User is aware and accepts that if the event were to be partially or fully cancelled for any reason other than the one mentioned above (by way of example but not limited to: sudden unavailability of the teacher) any sum already invoiced and paid will be reimbursed pro rata temporis for the unused part of the lesson. There is no compensation deriving from the cancellation of the lesson other than the full or partial refund of the amount of the lesson itself.
5.5 The student undertakes to participate by connecting to the live streaming punctually and according to the times and methods indicated by e-mail by the Supplier, and agrees not to claim anything by way of reimbursement should he/she not attend the event for reasons that do not depend on the Provider or the teacher.
5.6 When specified by the Supplier on the site and on the purchase pages, participation in live streaming can be requested with the role of “Auditor”. Participation as an Auditor consists in accessing live streaming but does not include interaction with the teacher with the exception of specific moments and with specific methods communicated by email and/or during the event by the Supplier and/or the teacher.
5.7 The student has the right to access the live streaming recordings made by the Supplier for a limited period of time: the methods and duration of access are communicated by the Supplier on the live streaming purchase page and/or by e-mail.
5.8 The student is not authorized to make recordings and/or download the live streaming and the recordings of these made available by the Owner.
5.9 If the Masterclass to which the Student is registered provides for it, in order to allow an adequate teaching activity by the Teacher, the student has the right to make one or more video recordings, making them according to the instructions received via email from the Owner after the purchase of the Masterclass service, in which they perform one or more musical performances so that these can be examined by the Teacher for educational purposes during the Masterclass.
The Student sends each registration via upload (loading) in the appropriate area of their account, according to the instructions received by e-mail from the Owner.
The Student acknowledges that they are solely responsible for the audio and video quality of their recordings, and that the quality of understanding by the Teacher of the performances recorded in them depends on this.
The Student guarantees that the recordings sent do not infringe the rights of third parties, and are not offensive towards third parties, indemnifying and holding the Owner harmless from any liability deriving from the publication of the recordings.
The student assigns exclusively and definitively to the Owner the rights of economic use of the sent recordings, free of charge and without claiming anything from the Owner. The Student authorizes the Owner to transfer the rights of economic use of the recordings to third parties in any form and for any use.
The student accepts that the Owner may, at their sole discretion, choose to publish the submitted recordings on the platform and/or during live streaming or not to publish them, or to remove already published recordings from the platform.
The student authorizes the Owner to carry out video and audio editing and montage of the recordings sent. The Owner undertakes to carry out video and audio editing and montages without harming the dignity and decorum of the student in any way.

6 PAYMENT OF THE CONSIDERATION
6.1 The details relating to the means of payment accepted are highlighted during the purchase procedure.
6.2 Payment is made online through the payment systems listed on the Site. The User must enter all the data indicated as mandatory in the payment form. The payment services are managed by third party suppliers, unrelated to IPFA, which in no case will come into possession or keep the User’s payment data. Therefore, IPFA declines any responsibility for any fraudulent or otherwise unauthorized use of the payment data entered by the User.
6.3 It will be possible to request the issuance of an electronic invoice via e-mail, which will be issued and stored in accordance with current Italian tax legislation. The User is aware and accepts that it will be their responsibility, following registration, to send via email to info@internationalpiccolofluteacademy.com tax code and / or VAT number and / or other data for billing in case they wish the issuance of an invoice with this indication, within 3 days of registration.
6.4 Until payment of the full purchase price is received by the Owner, the User does not obtain the License on the Digital Contents nor access to the Platform and the activation of the Academy Subscription and/or access to the Academy Services Masterclasses.
6.5 The Academy Subscription begins on the day the Account Holder receives the payment and remains active for the entire subscription period.
6.6 In the case of purchasing an Academy Subscription, during the purchase the User accepts that the automatic renewal has already been activated and authorizes the Supplier to automatically process payments for future purchases. The authorization can be revoked at any time using your user area or by sending an e-mail directly to the Supplier at support@internationalpiccolofluteacademy.com. In the event that IPFA is unable to charge the amount due and authorized by the User, IPFA may invoice the Customer for the Service and suspend access to the Service until payment has been made. In case of revocation, the subscription will terminate on the expiration date.
6.7 The prices of all the Services are indicated in euros and include VAT, where due.

7 RIGHT OF WITHDRAWAL AND REFUND
7.1 In case of purchase of an Academy Subscription, the User has the right to cancel the purchase order no later than 14 days from the conclusion of the Contract, without penalty and without specifying the reason.
7.2 In the case of the purchase of an Academy Subscription, in addition to the possibility of exercising the right of withdrawal provided for by law, the Owner grants the User the right to cancel the subscription and obtain a refund of the price within the first 30 days from activation date. This policy, also defined as “satisfied or reimbursed“, will however only be valid for the first activation of the subscription and may be revoked by the Owner at any time. If the Owner determines that the User is abusing the refund policy, we reserve the right to suspend or terminate their account and refuse or limit any current or future use of the Service without providing a refund.
7.3 To exercise the right of withdrawal, the Customer must send a communication to the following e-mail address: support@internationalpiccolofluteacademy.com. The Customer has the right to use the withdrawal form made available at the following link.
7.4 Without undue delay and in any case no later than 14 days from receipt of the request for withdrawal, the Supplier will refund the amount paid using the same payment instrument used by the Customer during the purchase unless the Customer has expressly agreed otherwise and on condition that they do not have to incur in any costs as a consequence of the reimbursement.
7.5. Pursuant to Art. 59 of the Consumer Code, paragraph 1 letter n) for the Academy Masterclass Services the right of withdrawal will not apply since these are services relating to leisure activities with a specific date or period of execution.

8 SUSPENSION AND CANCELLATION OF THE ACCOUNT
8.1 The Owner reserves the right to suspend immediately or in the most serious cases to cancel the User’s account by terminating the Contract in the event of even one of the following circumstances:
– adopting a conduct that is not respectful towards of the Owner and other Users of the Site or teachers, including through the publication of offensive comments or irrelevant or inappropriate content;
– publishing information and personal data of third parties without the authorization of the interested party;
– sending spam (unsolicited advertising, repeated messages);
– publishing links on the Site that redirect to external sites for advertising purposes or in any case for purposes unrelated to the subject of the Services;
– advertising third party websites or commercial activities;
– uploading, publishing, sending messages or in any other way transmit or disseminate materials, contents or texts that involve the violation of the industrial and / or intellectual property rights of third parties, or that tend to appropriate the popularity of a brand or a company using its name or trademark without authorization;
– downloading, copying, distributing, publishing Contents and images on this Website, including the data of Users or teachers who have published them without the prior authorization of the Owner;
– publishing, sending or uploading messages, phrases, data and content that contain imprecations, offensive expressions or language that may annoy, harass, embarrass, scare or disturb other Users, teachers or the Owner and content that may in any other way harm the dignity of others; contents that contain spyware, adware, viruses, corrupted files, worms or other malicious code capable of interrupting, damaging or limiting the functionality of the Site and more generally of the Service.
8.2 The suspension or cancellation of the account and the Service for the reasons indicated above does not give the User any right to compensation, reimbursement or indemnity. The suspension or cancellation of an account for reasons attributable to the User does not exempt the User from paying any fees or prices that may be applicable.
8.3 For the Academy Masterclass Services, the Student acknowledges that the Owner or the Teacher have the right to exclude any Student from the live broadcast, even if only partially (by way of example but not limited to: by deactivating the microphone and/or obscuring the video camera) according to their exclusive and unquestionable judgement, if the Student’s conduct is considered inappropriate and/or hinders the proper conduct of the lesson. The Student accepts that they will have nothing to claim from the Supplier by way of reimbursement and compensation, following their temporary or permanent exclusion.

9 INTELLECTUAL PROPERTY
9.1 The User acknowledges and accepts that the Service may contain data, information or features protected by copyright and intellectual and industrial property rights, such as trademarks, software, codes, logos, photos and images, names and secrets commercial. The Contents, data and functions of the Platform are the exclusive property of IPFA and / or third parties who have licensed IPFA to use them, and are protected against unauthorized use, copying and dissemination by law. in the field of intellectual and industrial property. 10 DISCLAIMER OF LIABILITY AND WARRANTIES

11 MODIFICATIONS TO THE CONTRACT
11.1 The Owner reserves the right to modify this Contract at any time, so that it is always consistent with any modification of the Services or with any legal, regulatory, jurisprudential and/or technical developments or constraints.
11.2. In this case, the Owner will give appropriate notice of the changes to the Users. The User’s continued use of the Service constitutes acceptance of the updated Terms of Service. In the event that changes are made to the Contract that have a significant impact on the Users’ rights, on the characteristics of the Service or on the applicable rates, the User will have the right to withdraw from the Service or Services subscribed by sending a communication to the Owner via e-mail, regular mail or by accessing the profile settings, without any penalty, within and no later than 15 days from receiving the communication via e-mail. I Suoi dati personali sono trattati per le seguenti finalità:

a) consentire all’utente di registrarsi e utilizzare la Piattaforma;

e) acquisire statistiche e metriche volte a garantire il corretto funzionamento della Piattaforma;

f) gestire le richieste degli utenti;

g) esercitare i diritti del Titolare (ad esempio il diritto di difesa in giudizio).

Le basi giuridiche dei trattamenti sopraelencati sono le seguenti:

relativamente alle finalità a), b), d) e f) il trattamento è necessario all’esecuzione di un contratto di cui l’interessato è parte o all’esecuzione di misure precontrattuali adottate su richiesta dello stesso;
in relazione alle finalità c) il trattamento è necessario per adempiere un obbligo legale al quale è soggetto il titolare del trattamento.

j) Acconsentire che, i dati anagrafici (nome e cognome), comunicati interagendo con il form presente nella sezione “Nicola Answers”, vengano citati da Nicola Mazzanti nei video pubblicati per rispondere alle domande ricevute.

Il conferimento dei Dati per le sopramenzionate finalità è libero e facoltativo. Lei potrà quindi decidere di non conferire alcun dato o di negare successivamente la possibilità di trattare Dati già forniti: in tal caso, non potrà ricevere offerte relative ai Prodotti e Servizi offerti dal Titolare o da partner del Titolare. Relativamente alla finalità j), in assenza di consenso, Nicola risponderà alla domanda senza citare nome e cognome dell’interessato. Potrà revocare il consenso al trattamento Dati in qualsiasi momento senza pregiudicare la liceità del trattamento basata sul consenso prima della revoca.

Segnaliamo che, nel caso in cui l’utente acquistasse un abbonamento o altri servizi offerti all’interno della Piattaforma, potremmo inviargli comunicazioni commerciali relative a servizi e prodotti del Titolare analoghi a quelli di cui ha già usufruito, salvo l’esercizio dell’opt-out (art. 130 c. 4 Codice Privacy).

Durata del trattamento

I dati personali saranno conservati per il tempo necessario ad adempiere alle finalità indicate nella presente informativa. Il Titolare conserverà per dieci anni, come richiesto dal Codice Civile, copia della corrispondenza a rilevanza giuridica e commerciale. Comunicazione dei Dati

I Dati dell’utente non saranno diffusi ma potranno essere resi accessibili, ove necessario per l’erogazione dei servizi o per legge:

a dipendenti e collaboratori del Titolare in Italia e all’estero, nella loro qualità di soggetti autorizzati al trattamento di dati personali e/o amministratori di sistema;

Trasferimento dei dati

3. Data Retention

Personal Data will be kept for the time necessary to fulfill the purposes indicated in the present Privacy Notice. As required by the Civil Code, the Data Controller shall preserve a copy of the correspondence with legal and commercial relevance for ten years. Additionally, the user’s Personal Data may be preserved for the time necessary to guarantee that the Data Controller may exercise rights such as the right for defense in court or to pursue abuses of the Platform’s services.

The Marketing and Profiling Data may be preserved for a period not exceeding 36 months since the last user’s interaction with the Platform.

The contacts used for marketing activities and the personal data mentioned in the “Nicola Answers” videos will be retained until consent is withdrawn by the Data Subject.

4. Communication of Data

The user’s data will not be disclosed but may be made accessible if necessary for the provision of services or by law:

– to employees and collaborators of the Data Controller in Italy and abroad, in their capacity of subjects authorized to process personal data (for example system administrators);

5. Transfer of data

Personal data are stored on servers located within the European Union, managed by third party companies appointed as Data Processors.

6. right to data portability – receive an electronic copy of the data concerning you (when such data have been rendered in the context of the contract) and request that the data in question be transmitted to another data controller.

7. Processing of Minors’ Data

In Italy, you must be at least 18 years old to use the Services. In some jurisdictions, this age limit may be different. If you are under the age required in your country to accept the Privacy Policy, your parent or guardian must accept it on your behalf. We may require reasonable proof of this release. In this case, the release must be provided no later than 5 working days after the request. If we do not receive any response or evidence, we reserve the right to delete the user’s account and all data collected.

The same considerations apply to accepting the Platform’s Terms and Conditions other than the present Privacy Notice.

We do not knowingly collect information about children under the age of 18. If we discover that a minor under the age of 18 has provided us with personal data, we will delete the information collected.
